„Репортери без граници”: Плачевно е, че в България медия може да бъде осъдена за публикуване на читателско писмо!
 
"Репортери без граници" протестира срещу присъдата в размер на 28000 лв. (14000 евро), която седмичникът „Виделина” (www.videlinabg.com) е разпоредено да плати до 14 юли за публикуване на читателско писмо през октомври 2007 г., с което се обвинява местен политик в корупция.

„Жалко е, че вестник или списание могат да бъдат осъдени за публикуването на читателско писмо”, казват репортери без граници. ”Виделина” не може да бъде винена или държана под отговорност заради вижданията, изразени от неин читател, който всъщност поема пълната отговорност за това, което е написал. Хората, които са били критикувани от читателката Кунка Делчева, е трябвало да използват правото си на отговор във „Виделина” вместо да я дават под съд.”

Осъден на първа инстанция от съдия Невена Танкова от Окръжния съд в Пазарджик, присъдата на вестника е потвърдена от Апелативен съд в Пловдив на 10 април 2009 г. През май съдия-изпълнител разпорежда замразяване на банковите сметки на издателя на „Виделина”, „РИК ЕЛИ”.

Редакторът на вестника, Валентин Ненков, е обжалвал решението пред Върховен съд, но неговата жалба не спира изпълнението на присъдата и на 30 юни е разпоредено, че  "Виделина" е длъжна да изплати пълния размер на глобата до 14 юли най-късно.

"Репортери без граници" добавя: "Размерът на глобата е напълно несъразмерен, особено за страна от Европейския съюз, и заплашва съществуването на вестника. Ние искаме от съдиите да изчакат поне решението на Върховния касационен съд преди изземването на пари от сметките на вестника. И Върховният съд логично трябва да опровергае присъдата на основание, че тя нарушава основните принципи на свободата на пресата. "

Reporters Without Borders condemns the fine of 28,000 levas (14,000 euros) which the weekly Videlina (www.videlinabg.com) has been ordered to pay by 14 July for publishing a reader’s letter in October 2007 accusing a local politician of corruption. The fine has been upheld by an appeal court in the southern city of Plovdiv.

“It is deplorable that a newspaper or magazine can be convicted for publishing a reader’s letter,” Reporters Without Borders said. “Videlina cannot be blamed or held responsible for the views expressed by one of its readers, who anyway said she assumed complete responsibility for what she was writing. The people who were criticised by this reader, Kunka Delsheva, should have used their right of reply in Videlina instead of suing it.”

The initial ruling against Videlina, issued by judge Nevena Tankova of the Pazarjik regional court, was confirmed on 10 April by the Plovdiv appeal court, which in May ordered the freezing of the bank accounts of ELI, the publishing house that owns Videlina.

The magazine’s editor, Valentin Nenkov, has appealed against the ruling to a higher court, but his appeal does not suspend execution of the sentence and Videlina was ordered on 30 June to pay the full amount of the fine by 14 July at the latest.

Reporters Without Borders added: “The size of this fine is totally disproportionate, especially in a European Union member country, and threatens the magazine’s survival. We urge the judges to at least await the decision of the higher appeal court before seizing the money from its accounts. And the higher court should overturn the judgment on the grounds that it violates the basic principles of press freedom.”

L’hebdomadaire Videlina menacé de fermeture

Reporters sans frontières proteste contre le maintien par la cour d’appel de Plovdiv de la condamnation pour diffamation de l’hebdomadaire Videlina (www.videlinabg.com) à une amende de 28 000 leva (14 000 euros). La décision fait suite à la publication, le 23 octobre 2007 dans le courrier des lecteurs de Videlina, d'une lettre signée par une lectrice, Kounka Delcheva, qui accusait une personnalité politique locale de diverses malversations.

« Il est déplorable qu’un organe de presse puisse être condamné pour la publication d’un courrier de lecteur. Videlina ne peut être considéré comme responsable ou commanditaire des propos tenus par un de ses lecteurs qui a de surcroît assumé toutes la responsabilité de ses propos dans sa lettre et lors de son témoignage. Les personnalités mises en cause par Kounka Delcheva disposent par ailleurs d’un droit de réponse dont elles auraient pu faire usage avant d’attaquer le journal », a déclaré Reporters sans frontières

Condamné en première instance par la juge Nevena Tankova de la cour régionale de Pazardjik, le jugement a été confirmé par la cour d'appel de Plovdiv le 10 avril 2009. En mai 2009, cette dernière a ordonné le gel des comptes bancaires de la société d’édition ELI, propriétaire de Videlina. Le pourvoi en cassation engagé par Valentin Nenkov, rédacteur en chef de Videlina, n’étant pas suspensif, l’hebdomadaire a reçu le 30 juin 2009 une injonction l’obligeant à payer la totalité de l’amende pour le 14 juillet au plus tard.

« Au sein d’un pays membre de l’Union européenne, le montant de l’amende est totalement disproportionné et menace l’existence même de l’hebdomadaire. Nous demandons aux juges d’attendre au moins les résultats de la Cour de Cassation avant de procéder à la saisie de l’amende. Cette dernière doit en toute logique annuler cette condamnation qui va à l’encontre des principes de base de la liberté de la presse en vigueur», a conclu l’organisation.
